A dispute over pickleball noise and governance has moved to court, with two Boca Raton families suing their community association over the conversion of tennis courts they say was done without proper approval and has disrupted nearby homes.
Joseph and Ivy Sullivan and Drs. Richard and Marci Kitt sued their community association, Parkside at Boca Trail, in March 2025, alleging the association improperly converted tennis courts into pickleball courts without required member approval and failed to address excessive noise affecting nearby homes.
The case continues to move through Palm Beach County Circuit Courts with its most recent filing just last month. The Sullivans purchased their property in 1994, while the Kitts bought their home in 2006. According to the lawsuit, the association’s board of directors began discussing the conversion of a portion of the tennis courts to pickleball in 2021 without investigating the impact on surrounding residences.
The association also failed to inform members of potential downsides associated with pickleball, including noise, despite the availability of such information, the suit states.
